What is the source of my data – where is it obtained from?

We always obtain personal data directly from you. If you purchase goods through the TT Technology Online Store, you provide us with your data because it is necessary for the proper execution of the sale.

What is the scope of the personal data processed by the Administrator and the purpose of the processing?

The subject matter of the Administrator’s business is the sale of led lighting articles, etc. through the TT Technology Online Store. Personal data is processed for different purposes, to a different extent, and under different legal basis specified in the RODO. The term of storage of personal data is also different. In order to provide you with the clearest possible information, we have grouped this information by referring to the purpose of processing your personal data.

Personal data is necessary for the performance of the contract concluded with you, in particular:

  1. provision of electronic sales services and full use of our online trading platform, including making transactions, placing orders, payments, and delivery by our trusted contractors;
  2. setting up and managing your account or accounts, and providing support for your account, transactions and resolving technical problems;
  3. complaint handling when you make such a complaint;
  4. handling of requests that you direct to us (e.g., via the contact form);
  5. To contact you, including for purposes related to the provision of a sales or delivery service

In addition, we are required by law to process your data for tax and accounting purposes. We also process your personal data on the basis of the Company’s legitimate interest, which is:

Purchase through the TT Technology Online Store:

For this purpose, personal data is processed mainly to:

  1. contact the customer to inform him of updates regarding the order placed or to provide him with information related to the products or services ordered,
  2. manage payments for purchased products, regardless of the payment method selected,
  3. activate the necessary mechanisms, in order to prevent possible abuse against you and against us during the purchasing process,
  4. manage any returns after a purchase and to manage inquiries about product availability, product reservations or service provision,
  5. for invoicing purposes and to issue receipts and invoices for purchases made through the TT Technology Online Store.

Data scope. In order to use the TT Technology online store, the following personal data is processed:

  1. for Consumers – e-mail address, first name, last name, delivery address, country (goods can only be delivered within Poland), phone number, bank account number,
  2. for Entrepreneurs – e-mail address, first and last name of the person placing the order, delivery address, country (goods can only be delivered within Poland), phone number, bank account number, name of the business activity, Tax Identification Number (NIP), address of the business activity.

Legal basis. Personal data is processed on the basis of Article 6(1)(b) of the RODO, i.e. in connection with the conclusion and performance of the sales contract concluded between KT TRADE sp. z o.o. sp. k. and the Client.

Processing time for personal data. We will process your personal data for the time necessary to manage the purchase of products acquired by you, including any returns, complaints, or claims related to a specific product or service. We will process the data no later than the date of expiration of claims arising from the concluded sales contract or the cessation of tax obligations related to the conclusion of the contract (we will process personal data for a maximum of 2 years from the date of concluding the sales contract).

Return of goods (withdrawal from the contract of sale)

Data scope. For this purpose, the Administrator processes the following personal data: e-mail address, first name, last name, delivery address, country, telephone, bank account number, data from a named VAT invoice (if issued).

Legal basis. Personal data is processed on the basis of Article 6(1)(c) of the RODO – processing of the Customer’s personal data is necessary for the Administrator to fulfill its legal obligation under the law (exercise of the right of the buyer of goods at a distance to withdraw from the contract).

Processing time for personal data. We will process your personal data for the time necessary to manage the purchase of products acquired by you, including any returns, complaints, or claims related to a specific product or service. We will process the data no later than the date of expiration of claims arising from the concluded sales contract or the cessation of tax obligations related to the conclusion of the contract (we will process personal data for a maximum of 3 years from the date of concluding the sales contract).

Complaining about goods purchased through TT Technology’s Online Store

Data scope. In order to process a complaint, the Administrator processes the following personal data:

  1. Consumers – e-mail address, name, surname, delivery address, country phone, bank account number, data from a registered VAT invoice,
  2. Entrepreneurs – e-mail address, name of the person placing the order, delivery address, country, telephone, bank account number, data from the VAT invoice.

Legal basis. Personal data is processed on the basis of Article 6(1)(c) of the RODO – processing of the Customer’s personal data is necessary for the Administrator to fulfill its legal obligation under the law (realization of the Buyer’s rights under the warranty for defects in goods)

Processing time for personal data. We will process your personal data for the time necessary to manage the purchase of products acquired by you, including any returns, complaints, or claims related to a specific product or service. We will process the data no later than the date of expiration of claims arising from the concluded sales contract or the cessation of tax obligations related to the conclusion of the contract (we will process personal data for a maximum of 2 years from the date of concluding the sales contract).

Conducting marketing activities

For this purpose, data is processed mainly to send newsletters, regarding our products. Please note that you can unsubscribe from the newsletter at any time, free of charge, by following the instructions in any correspondence sent by us. In addition, we process your personal data for promotional activities (for example, to run contests).

Data scope. For this purpose, the Administrator processes personal data including e-mail address, name, surname, sometimes image.

Legal basis. The legal basis for processing your data for marketing purposes is the consent you have given to process your data for this purpose. The legal basis for processing your data is Article 6(1)(a) of the RODO.

Processing time for personal data. We will process your personal data until you withdraw your consent. For newsletters, we will process your personal data until you revoke your consent to receive marketing communications via email. We will process your personal data for a maximum of 1 year from the date you last opened an email.

IT support

For this purpose, your personal data is processed mainly to ensure proper IT support of the sales contracts executed by us through the TT Technology Online Store, as well as to ensure proper operation of the website https://www.tttechnology.pl/pl/ (hereinafter: TT Technology Online Store) , newsletter dispatch, etc.

Scope of data: Data resulting from cookies [link to Cookie Policy], as well as all other data that we process in connection with the Administrator’s IT service (e.g., monitoring data).

Legal Basis: The legal basis for the processing of your data for IT support purposes is our legitimate legal interest in providing proper service to the TT Technology Online Store. The legal basis for data processing is Article 6(1)(f) of the RODO.

Duration of storage of personal data: We will process your personal data for the duration of the storage of cookies or for the retention period indicated for other processing purposes (e.g., in the case of processing in connection with the purchase of goods, we will process data up to the date of expiration of claims from the concluded contract).

Statistics on the use of individual functionalities of the TT Technology Online Store and facilitate the use of the store, ensure the IT security of the site

Data scope. For these purposes, we process personal data about your activity on the TT Technology Online Store, such as the pages and subpages you visit, the amount of time you spend on each page, as well as data about your search history, your IP address, location, device ID, and browser and operating system data.

Legal basis. The basis for the processing of personal data is Article 6(1)(f) of the RODO, i.e. the legitimate legal interest of the Administrator to facilitate the use of services provided electronically and to improve the functionality of these services (services provided via https://www.tttechnology.pl/ , including the online store).

Processing time for personal data. We will store your personal information for the duration of time cookies are stored on your device (you can change your cookie storage settings yourself).

Customer contact – handling complaints, requests, inquiries

Data scope. For this purpose, we may process the personal data you provide in connection with your inquiries, as well as data regarding the use of our services or the purchase of goods that are the cause of the complaint or request, and data contained in the documents attached to the complaint or request.

Legal basis. Our legitimate interest (Article 6(1)(f) RODO) in improving the functionality of our services and better tailoring our offer to the needs of buyers. In addition, our legitimate interest is related to building positive relationships between the Administrator and the customer, based on reliability and loyalty.

Processing time for personal data. We process personal data for the duration of the response to the customer’s inquiry, complaint or request. After that, the personal data is deleted. At the latest, the data are deleted within two months from the date of the complaint, request or inquiry.

Accounting, bookkeeping

Data scope. If we issue a VAT invoice or a named receipt, we are obliged, by applicable law, to keep these documents and process the personal data contained therein (including: name, surname, address, business name, TIN, business address) for accounting and bookkeeping purposes.

Legal basis. The legal basis for the processing of personal data is Article 6(1)(c) of the RODO, i.e. the need for the Administrator to fulfill its obligations under the law.

Personal data processing period. Personal data is processed by the Administrator for the period of retention of accounting, financial, and tax documentation. We store issued named receipts and VAT invoices until the expiration of tax liabilities, i.e., for 5 years, counting from the end of the calendar year in which the tax payment deadline expired.

Determination, investigation and enforcement of claims

Data scope. For this purpose, we may process some of the personal data you provide: name, surname, data on the use of our services or purchased goods, image obtained from monitoring, if claims arise from the way you use our services or purchase goods, other data necessary to prove the existence of a claim, including the extent of the damage suffered.

Legal basis. Our legitimate interest (Article 6(1)(f) of the RODO), consisting in the establishment, investigation and enforcement of claims and defense against claims in proceedings before courts and other state authorities.

Processing time for personal data. For this purpose, we will store personal data until the claims expire, i.e., for a maximum of 3 years from the date the Administrator became aware
of the damage and the person obliged to compensate for it.

To whom is my personal information shared?

The Personal Data Administrator, with the utmost care for the confidentiality of your personal data. Due to the necessity of fulfilling contractual obligations and ensuring the proper functioning of TT Technology’s online store, personal data is provided to the persons indicated below.

Service providers, including IT

We transfer your personal data to the service providers we use to conduct our business. Suppliers supply the Administrator with technical and organizational solutions to provide services to users and organizational management. We also transfer data to providers of IT services to the Administrator, including providers of servers where personal data is stored.

Providers and partners of logistics, transportation, delivery services

We transfer your personal data to suppliers and partners who provide logistics, transportation and delivery services to us.

Administrator Support

We may transfer your data to providers of legal and consulting services and those supporting the Administrator in the enforcement of due claims (in particular, law firms), as well as to entities providing audit services to us.

State bodies

We share your personal data if we are requested to do so by authorized state authorities, in particular, prosecutor’s offices, the Police, the President of the Office of Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications.

Is my data transferred outside the European Union?

We do not transfer your personal data outside the European Union.

Is it my responsibility to provide data?

Provision of some personal data is necessary for the purchase of our goods through the TT Technology Online Store. The provision of other data is voluntary and is not necessary for the purpose of concluding and performing a contract. Required information is marked as mandatory in the TT Technology Online Store. The consequence of failing to provide this data is that the goods cannot be sold to you. Apart from the data marked as mandatory, providing other personal data is voluntary.

What rights do I have?

The Administrator, in connection with the processing of your personal data, ensures the exercise of your rights related to the processing of personal data, as described below. You can exercise your rights by submitting a request to:

Right to withdraw consent

You have the right to revoke the consent you have given for the processing of personal data for marketing purposes (i.e. in connection with sending newsletters), if you have given it. Withdrawal of consent has effect from the moment of withdrawal. Withdrawal of consent does not affect processing carried out by us lawfully before its withdrawal. Withdrawal of consent has no negative consequences for you.

Right to object to the use of data

You have the right to object at any time to the use of your personal data if we are processing your data based on our legitimate interests, such as in connection with keeping statistics on the use of particular website functionalities and facilitating the use of the website.

If your objection proves to be valid and we have no other legal basis for processing your personal data, we will delete your data against the use of which you have objected.

The right to erasure of data (the so-called “right to be forgotten”)

You have the right to request the deletion of all or some of your personal data. We will treat a request to delete all of your personal information as a request to delete your Account.

You have the right to request deletion of your personal data if:

  1. you have withdrawn specific consent, to the extent that personal data was processed based on your consent,
  2. Your personal data is no longer necessary for the purposes for which it was collected or for which it was processed,
  3. you have objected to the use of your data for the purpose of conducting statistics on the use of the Website and satisfaction surveys, and the objection has been found to be valid,
  4. Your personal data is being processed illegally.

Despite your request to delete your personal data, we may retain certain personal data to the extent necessary for the purposes of establishing, investigating or defending claims. This applies in particular to personal data including: first name, last name and email address, which we retain for the purposes of investigating complaints and claims related to the use of our services.

The right to restrict data processing

You have the right to request that we restrict the processing of your personal data. If you make such a request, we will prevent you from using certain functionalities or services, the use of which will involve the processing of the data covered by the request, until the request is processed.

You have the right to request restrictions on the use of your personal data in the following cases:

  1. when you question the accuracy of your personal data – then we will restrict its use for the time we need to verify the accuracy of your data, but no longer than for 7 days,
  2. when the processing of your data is unlawful, and instead of deleting the data you request a restriction on its use,
  3. When your personal data is no longer necessary for the purposes for which we collected or used it, but you need it to establish, assert or defend your claims,
  4. when you have objected to the use of your data, in which case the restriction is for the time needed to consider whether, due to your particular situation, the protection of your interests, rights and freedoms outweighs the interests we pursue by processing your personal data.

Right of access to data

You have the right to obtain confirmation from us as to whether we are processing your personal data, and if we are, you have the right:

  1. gain access to your personal information,
  2. obtain information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients of such data, the intended period of storage of your data or the criteria for determining that period, your rights under the RODO and your right to lodge a complaint with a supervisory authority, the source of such data, automated decision-making, including profiling, and safeguards applied to the data.

Right to rectify data

You have the right to correct and complete the personal information you have provided. You can do this yourself in the Settings (Privacy) tab. With respect to other personal data, you have the right to request that we correct this data (if it is incorrect) and complete it (if it is incomplete).

Right to data portability

You have the right to receive your personal data that you have provided to us and then send it to another personal data controller of your choice, such as another operator of similar services. You also have the right to request that we send your personal data directly to such other controller, if technically possible.

At what time do we fulfill your request?

If, in the exercise of the above-mentioned rights, you make a request to us, we will either fulfill the request or refuse to fulfill it immediately, but no later than one month after receiving it. However, if – due to the complexity of the request or the number of requests – we are unable to fulfill your request within one month, we will fulfill it within another two months informing you in advance of the intended extension of the deadline.

The right to file a complaint

If the processing of personal data violates the law, you may file a complaint with the supervisory authority about the processing of personal data by the Personal Data Controller. The complaint can be submitted to the President of the Office for Personal Data Protection (Office of the President of the Office for Personal Data Protection 2 Stawki Street, 00-193 Warsaw).
